The Council of this fortress de Goede Hoope, reinforced by the skippers and merchants of the ships, Peerl and Henriette Louijse, has met today and is seated to discuss the matter of the silly misfortune of the defeat that happened yesterday afternoon to the person of Jerasmus Teunisz of Tonsbergen in Norway, by Claes de Logie of Amsterdam, boatswain, standing with a rudder loaded at the bulkhead283 outside the cabin in front of Comp's fortress, and having been captured by the same without knowing that it was loaded; as well as pointing towards the aforementioned Jerasmus and unashamedly departing from the aforementioned. Jerasmus was shot in the back of his brain, which immediately fell to the ground and died an hour or two later, as was publicly revealed to all people, etc.

And noting that the aforementioned misfortune, according to the actual voluntary confession of the prisoner284 and the testimony of the bystanders, as well as other documents, occurred very innocently without any premeditation, and the postman285 showed great remorse and sorrow with numerous complaints, etc., the Council, as above, has decided by form of resolution (due to the hasty departure286 of the ships and the aforementioned reasons not to condone a trial), after due deliberation, to condemn the prisoner (believing him innocent and therefore excusing him from the penalty of manslaughter) on account of his innocent carelessness to a year's imprisonment at the hands of the E. Compe. here to serve without pay.

Thus done and resolved in the Fort of Good Hope on the day and year as above.

Den Raedt deser fortresse de Goede Hoope versterckt met de schippers ende coopluijden van de schepen, Peerl ende Henriette Louijse , heden vergadert ende geseten sijnde over de saecke van het onnosel ongeluck des nederlage gister namiddagh geschiet aen den persoon Jerasmus Teunisz van Tonsbergen in Noorwegen , door Claes de Logie van Amsterdam, bootsman, met een snaphaenroer staende geladen bij ‘t verckenschot283 buijten de combuijs voor Comps. fortresse, ende bij den selven opgevat sijnde sonder te weten dat het geladen was; mitsgaders daer mede na den voorsz Jerasmus wijsende ende onversiens affgaende voors. Jerasmus daer door achter in sijn harsenpan heefft geschoten, dat terstont is ter aerde gevallen ende een uijr of twee daer na comen te sterven, als openbaer gebleecken voor allen volcqe, &a.

Ende gemerckt dan voorsz ongeluck volgens de datelijcke vrijwillige bekenttenissevan den gevangenen284 ende getuijgenisse der omstanders als andere bescheijden daer van beleijt, seer onnosel sonder eenigh opset is geschiet ende den facteur285 groot berouw ende leetwesen met menichvuldige beclaeghreden is toonende &a., soo is bij den Raet versterckt als boven bij forme van resolutie (om ‘t haestigh vertreckt286 der schepen ende redenen voorsz geen proces goetvindende te maken) na wel genomen deliberatie verstaen, den gevangen (onnosel houdende ende dierhalven van de straffe des dootslaghs excuserende) ten aensien van sijne onnosele onvoorsichticheijt te condemneren om een jaer langh d’ E. Compe. hier aen lant sonder gagie te dienen.

Aldus gedaen ende geresolveert in ‘t Fort de Goede Hoope ten Dage ende jare als boven.
