The Council having been expressly summoned by Commander Simon van der Stel on the subject of the disobedience in the guard of the Lieutenant of this garrison, Jan Baptist Dubertijn, existing as his E. came to propose in this Council that the said Lieutenant was expressly ordered to report directly to his E. and to no one else in the morning, when the main guard was in command; however, having still audaciously admonished him to report contrary to this express order to the Captain of this garrison, when it was his duty to report first, as well as the day before yesterday, when it was his duty, to report to his E., but on the contrary refused to report this matter to the Captain. addressed who had pointed him out to the Commander, without however anything being followed up, just as this morning, according to the captain's report, he again failed to leave his duty yesterday and to report to the Commander what had passed during the previous night, adding that he would not act in that regard, even if everything were to be turned upside down, having also never wanted to obey the order of his Honour that the senior officer on duty, be it captain, lieutenant or ensign, should be on duty and when the soldiers' parade is made on Sunday, should wear a sharp, as is customary among military officers in the Netherlands; to give all the reasons for which, the aforementioned lieutenant was summoned to the meeting by the fiscal of this residence, and also subsequently appeared, when the aforementioned alleged reasons for disobedience were presented to him, to which the same in this instance replied that he never refused to fully comply with the orders of the Lord Commander, nor ever to have renounced or refused when it was his duty to report to the Lord Commander himself what had passed in his charge, but also confesses to having reported to the captain contrary to the orders of the Lord Commander, said also the day before yesterday, when it was his duty to report to the Lord Commander. The Commander had made a report and had intended to do so this morning, and to that end, had awaited the Commander within the castle until His Eminence was present, but in the meantime, he had been summoned to this meeting by the bailiff in this regard. Regarding the last point, the Commander replied that he had never refused the Commander's order to comply.

Then, furthermore, in the presence of the present members of this meeting, the Commander, for the sake of all other men, called upon the aforementioned captain and lieutenant. orders that the following order be observed from now on, without the slightest deviation, in the same manner as it is inserted word by word here:

"Order and regulation by which the chief military officers, namely the captain, lieutenant, and ensign of this garrison, will henceforth have to regulate without the slightest deviation:112"

"Firstly, the captain of this garrison will have the oversight and command in general of all the craftsmen, including carpenters, masons, smiths, wagon makers, wagon drivers, woodcutters, etc., and must also ensure that they do not fail in their daily work."

"The aforementioned captain It will also be required to collect the Commander's own orders every evening and simultaneously make a general report on what has happened that day in the guard and furthermore in the general area within the Castle.

"The command of the main guard will be rotated among the three senior officers, starting first with the captain and ending with the ensign."

"The officer in charge of the main guard, whether captain, lieutenant, or ensign, will personally report the incident to the Commander in the morning, unless the lieutenant or ensign will be able to report to the captain, unless the Commander were able to order it."

"The officer in charge of the main guard For as long as his watch continues, he must wear an orange scarf, so that it can be known which officer is on duty.

"Similarly, on Sundays, when the militia parade is held, the senior officers may not march without a field marker."

"As stated above in the captain's guard, the junior senior officers, such as lieutenant and ensign, when they are not on duty, may also not receive a report of what has passed outside their own watch."

Door den Commandeur Simon van der Stel den Raad expres geconvoceert zijnde over het subject van de disobedientie in ‘t reguarde van den luijtenant deses guarnisoens Jan Baptist Dubertijn, bestaande soo als zijn E. in desen Raden comt voor te dragen dat den voorn. luijtenant expresselijck is geordonneert wanneer de hooftwaght heeft, des s’ morgnas directelijck aan zijn E. en niemant anders rapport te doen; hem egter nogh hebbende verstout contrarie dese expresse ordre aan den capiteijn deses guarnisoens, wanneer ‘t zijn waght was eerst rapport te doen, mitsgaders eergisteren, wanneer ‘t zijn waght is geweest, geweijgert aan zijn E. rapport te doen, maar in tegendeel hem dien aangaande bij den capn. g’addresseert die hem tot den Commandeur hadde gewesen, sonder dat egter daarop ijets is gevolght, gelijck ook dese morgens volgens ‘t rapport van den capn. andermaal heeft gerefuseert van sijn gisterige waght en wat de voorleden nagh[t] is gepasseert aan den Commandeur rapport te doen, met bijvoeginge daartoe niet te sullen treden, al soude alles te ondersteboven keren, hebbende ook noijt willen gehoorsamen de ordre van sijn E. dat den hooftofficier die de waght heeft, ‘t zij capiteijn, luijtenant of vaandrigh, op haar waght en wanneer des Sondaghs de parade van de soldatesque wert gedaan, sullen aanhebben een cherp, gelijck als onder de militaire officieren in de Nederlande gebruijckelijck is; om van alle ‘t welcke redenen te geven, den meergemelte luijtenant door de fiscaal deser residentie ter vergaderinge is gedaghvaart, en ook gevolgelijck gecompareert, wanneer hem de vooren g’allegeerde redenen van ongehoorsaamheijt sijn voorgehouden, waar op de selven in deser voegen heeft gerepliceert, dat hij noijt heeft geweijgert de ordre van d’ Hr. Commandeur in allen deele na te comen, ook noijt te hebben gerefuseert off geweijgert wanneer ‘t zijn waght is geweest aan de Hr. Commandeur selfs rapport te doen wat in zyn waght is gepasseert, maar bekent ook in tegendeeltegend’ ordre van de Hr. Commandeur aan den capn. rapport te hebben gebraght, gel. ook verclaart eergisteren, wanneer ‘t zijn waght is geweest, aan d’ Hr. Commandeur rapport heeft gedaan en sulx van de morgen mede voornemens is geweest te doen, en tot dien eijnde binnen ‘t Casteel d’ Hr. Commandeur te hebben opgewaght, totdat Zijn E. byderhant was, dogh dat hij inmiddens door de gereghtsbode desen aangaande ter deser vergaderingh is gedaghvaart; en nopende ‘t laaste poinct repliceerden den selven noijt de ordre van de Heer Commandeur te hebben geweijgert om na te comen.

Zijnde dan vorders in presentie van de jegenwoordige leden deser vergaderingh door den Commandeur tot voorcominge van alle verdre mesusen den capn. en luijtenant voorn. geordonneert voortaan sonder de minste afwijckingh te observeeren de navolgende ordre soodanigh als deselve van woort tot woort hier geinsereert staat:

‘Ordre en reglement waar naar d’ militaire hooft officieren namentlijck den capiteijn, luijtenent en vendrigh deses guarnisoens voortaan sonder d’ minste afwijkingh sullen hebben te reguleeren:112 ‘

‘Eerstelijck sal den capn. deses guarnisoens de opsight en ‘t commando hebben in ‘t generaal over al de ambaghtsluijden, soo timmerluijden als metselaars, smits wagemaackers, wagenrijders, houtcappers &a., ook hebben te versorgen dat deselve in haren dagelijxen arbeijt niet comen te versuijmen.’

‘Den gemelten capn. sal ook gehouden wesen alle avonden d’ ordre van den Commandeur selfs aff te halen en te gelijck een generaal rapport te doen wat dien dahg in de waght en vorders in ‘t generaal binnen ‘t Casteel gepasseert is.’

‘Het waarnemen van de hooftwaght sal bij de drie hooftofficieren bij beurten omgaan en eerstelijck van den capiteijn beginnen, en bij den vaandrigh eijndigen.’

‘Den officier die de hooftwaght heeft, ‘t zij capiteijn, luijtenant off vaandrigh, sal des s’ morgens selfs in persoon van ‘t gepasseerde rapport doen aan den Commandeur, sonder dat den luijtenant of vaandrigh aan den capiteijn sullen vermogen rapport te doen, ten ware den Commandeur sulx quame te ordonne[ren].’

‘Den officier die de hooftwaght heeft, sal soo lange zijn wagt continueert, moeten aanhebben een oranje cherp, opdat men sal connen weten bij welcken officier de waght wert waar genomen.’

‘Soo sullen mede des Sondaghs, wanneer de parade van de militie wert gedaan, d’ hooftofficieren niet mogen marcheeren sonder een veltteycken.’

‘Gelijck hier vooren in ‘t reguardt van den capiteijn is gesegt, Soo sullen de mindere hooftofficieren als luijtenant en vaandrigh, wanneer ‘t haar waght niet en is, ook geen rapport mogen ontfangen wat buijten haar eygen waght is gepasseert.’

‘Sullende alle de mindere officieren gehouden wesen rapport te brengen aan den hooftofficier die de waght heeft, en aan den Commandeur rapport moeten brengen.’

Aldus geresolveert en g’arresteert in ‘t Casteel d’ Goede Hoop, datum ut supra.
