Having been presented at the meeting by the E. president, how one of the three fugitive informers, named Jan Jansz,26 had been seized the night before yesterday outside the countryside of a certain colonist in his vineyard and taken prisoner to the fort, and was now in custody: and whether it was not therefore necessary, on the grounds of his fugitive, as well as suspected horse theft and the transport of slaves, etc., to inform against him and to hand him over to the fiscal to be prosecuted in this matter according to law, then for the good services which he and his two fugitive companions performed last year in bringing private goods from the ship Tijdoor, cited to the E. Company. has done, it could well be of that consideration to use some connivance in this case; principally to free us thereby from all unanimous agreement that one (in the strictness of law here in proceedings) is against the aforementioned. persons were more formalized and passionately taken, as if they had been acquitted in favor of Justice to do and other false blame: and by which we could well be suspected and made guilty of the cause that in the future no such informers would easily come forward again, and this all the more so because of a wrong impression of the common mates, also because of the threat from the shipping authorities that such people were always treated here in this way in recompense for their informing, in order to make them abandon their good intention, etc. Whereupon deliberation was then made, it was decided to supersede the legal action on that matter in principle to the arrival of the Commissioner of Batavia; but in the meantime, to inform ourselves as much as possible about the suspected fact and to have the detainee heard and examined by the fiscal officer, as well as to keep him detained for the same length of time; perhaps the other two debtors might also be discovered in the meantime.

Ten vergaderingh door den E. praeses voorgedragen sijnde hoe dat een van de drij fugitive aanbrengers, Jan Jansz genaamt,26 eergisteren nacht, buijten ten platten lande van seecker colonier in sijn wijngaant g’attrappeert en gevancklijck aan ‘t fort gebracht, mitsgaders als nu in hechtenis geslooten was: en of ‘t dienvolgens niet en vereijste soo ter saecke van sijn fugie als gesuspecteerde paerdedieverij, en ‘t vervoeren van slaven &a. tegens hem g’informeert en in handen van den fiscaal overgelevert omme naar rechten in die saacke geprocedeert te werden, dan off d’ goede diensten die hij en sijn noch vluchtige twee mackers met het aanbrengen van particuliere goederen uijt ‘t schip Tijdoor ‘t verleeden jaar aangehaalt, aan d’ E.Compa. heeft gedaan, wel van die consideratie soude connen wesen om in dese saack wat oogluijckinge te gebruijcken; principalijck om ons daar door te libereren van alle eensijdige naespraack dat men (nae strenheijt27 van rechten hier in procederende) tegens d’ voors. persoonen meer geformaliseert en met passie ingenomen was, als wel ten faveur van d’ Justitie juijst genecessiteert hadden geweest te doen en andere falsche blame meer: en waar door men ons mede wel soude connen verdacht en schuldich maecken van oorsaack te wesen datt ‘er in ‘t toecomende geen soodanige aanbrengers haar lichtelijck meer mochten comen te vertoonen, en dat te meer uijt een verkeerde impressie van d’ gemeene maats, ooc wel uijt bedrijginge van de scheepsoverheden dat soodanige luijden hier altijdt op die wijs in recompens van haar aanbrengen getracteert wierden, ten eijnde om haar van hun goet voorneemen te doen absterrenen &a. Waarop dan gedelibereert sijnde, soo is verstaan met d’ rechtsvorderinge van die saacke ten principalen tot d’ comste van den heer Commissaris van Batavia te supercederen; doch ons inmiddels soo veel doenlijck op ‘tgesuspecteerde28 feijt t’ informeren en den gedetineerde door den fiscaal mede te doen hooren en examineren, mitsgaders soo lange gedetineert te houden; misschien dat tusschenwijle de twee andere schultplichtige mede noch ontdeckt mochten werden.
Aldus gedaan en geresolveert in ‘t Fort d’ Goede Hoop, datum ut supra.
