"With all due respect, inform the privileged Cape wine tapper, Tobias Marcquart, how the citizen Cornelis Stevensz, privileged liquor seller and tenant of the Comps vineyard at Rustenburg, also known as Rondebosje, outside the countryside, at the residence of the citizen Theunis Dircx, has appointed a man of his ways to serve the aforementioned purpose." to sell and peddle his own privately owned wines by the small measure, and that to reduce the price, namely the mixture to 3/8 Rxrs. whereas he had previously sold the mixture to 1/2 Rxr., as was set for that purpose by the authorities here, inserting that it was always sold by the petitioner here at the fort at such a price with which the aforementioned Cornelis Theunis's suppt. business was sufficiently covered, and thereby all the influx came to him, regardless of the fact that he, as your Honor is aware, is held in favor of the same, all the wines harvested by him at Rustenburg, to 20 Rx. to accept the half aam and that to the sum of 3000 guilders (being the amount of the rent of the said garden rustenburg), continuing to take over in addition to that the attached registers to 16 Rxrs. the half aam from the aforementioned Cornelis Stevens in the year, following which the calculation can be made sufficiently that, according to him, the said wine is calculated at the same price as the ordinary valuation itself to such a price of 1/2 Rxr. the m.78, besides that this drink, inserting it sufficiently clearly to everyone, remains very slightly deficient in becoming sour, consequently, according to him, not only is it impossible to be able to exist and heavy rent monies to the E. Comp. to raise, but even from that its total ruin can be inferred, seen by the present bad year and the fact that no return fleet has arrived here, and as when in principle the wines have to be sold, since such a remarkably large quantity of Cape wines is still overgrown and will be impossible to benefit from and sell, if by Your Honor good care is not provided for in time, the said Cornelis Stevensz, under the pretense of selling his own private wine, can also buy and sell the wine of other vineyards at his suppt. prejudgment, wherefore the suppt. is impressed upon him to Your Honor. to return, very respectfully and reverently requesting that the said Cornelis Stevensz may be authorized by Your Honorable Order to refrain from selling the Cape wines at such a reduced price, but up to 1/2 Rxr. the mixture, as was previously customary, not wishing to doubt that Your Honors will please consider that he has once again accepted the tax on the said wine this year, on the promise that he would be offered a helpful hand in everything that could prejudice him,79 inserting that a promise has been made to him by the late Mr. Governor. Whereupon the aforementioned tapper Cornelis Stevensz, after taking his view of the request, indicated in Rade that, in accordance with the written conditions entered into with the E. Company, he was authorized to sell Cape wine at a price lower than, but not higher than, half a Rxr. per mixture, as it currently sells for 3/8 Rxr. selling, with the addition that Marcquart had long since practiced and put into use the idea of selling less brandy than the authorities had stipulated, which he and others had had to accept, it seemed a strange matter to want to constrain him to keep it at an equally high price for the benefit of another, since in return he was free to give it away in whole or in part, requesting therefore to be maintained in his contract so that no increase in price could be resolved beyond his own detriment. These reasons having been taken into account and considered by us, it has been deemed appropriate to add an apostille to the aforementioned Marcquart's surviving request, stating that we did not consider it appropriate to obstruct the aforementioned Cornelis Stevensz in the supp.'s request, but that they themselves would mutually devise a means that would be the least detrimental to them both, offering our mediation in this regard.

‘Geeft met alle eerbiedige onderdanicheijt te kennen den geprevilegeerden Caapse wijntapper Tobias Marcquart hoe dat den borger Cornelis Stevensz, gepreviligeert dranckvercooper en pachter van ‘s Comps. wijngaart aan rustenburg alias rondebosje , buijten ten platten lande in d’ huijsing van den borger Theunis Dircx ijmant van sijnen’t wegen heeft gestelt om ter voors. plaatse sijn eijge particuliere gougste77 wijnen bij de cleijne maat te slijten en uijt te venten en dat tot verminderinge van prijs te weten de mengel tot 3/8 Rxrs. daar den selven nochtans voor heen d’ mengel tot 1/2 Rxr., gelijck als van d’ overicheijt alhier daar toe is gestelt, heeft vercocht, invoegen deselve door hem suppliant alhier aan ‘t fort altoos tot soodanige prijs is uijtgesleten, waarmede den gedagte Cornelis Theunis sijn suppts. neering genoegsam is ondercruijpende en daar door al den toelo[o]p comt nae hem te trecken, ongeacht dat hij suppt. gelijck U.EE. achtb. is bekent, in faveur van denselven gehouden is alle de wijnen door hem aan rustenburg geougst, tot 20 Rx. ‘t half aam en dat tot somma van 3000 gls. (sijnde ‘t bedragen van de pacht van gemelte thuijn rustenburg ) aan te nemen, blijvende nogh daar en boven verbonden wee leggers tot 16 Rxrs. d’ half aam van den meergemelte Cornelis Stevens in ‘t aar over te nemen, dien volgende die calculatie genoegsaam can werden gemaackt dat hem suppt. de gemelte wijn eenelijck gereeckent de ordinaire taxatie selfs tot soodanigen prijs van 1/2 Rxr. de m.78 komt te staan, behalven dat dien dranck, invoegen een ijder genoegsam kennelijck, ‘t suur worden seer licht onderwaardight blijft, consequentelijck hem suppt. niet alleen onmogelijck is te connen bestaan ende sware pachtpenningen aan d’ E. Comp. op te brengen, maar selfs daar uijt sijn totale ruijne te volgen staat, aangesien door ‘t presente slechte jaar en dat geen retour-vloot alhier is aangeweest, en als wanneer ten principale de wijnen moeten werden gesleten, dewijle nogh met soo een merckelijck groote quantiteijt Caapse wijnen overcropt sit en onmogelijck sal connen beneficeeren en uijtslijten, ingevalle door U.E.achtbare goede voorsorge daar in niet tijdigh wert voorsien, connende den gemelte Cornelis Stevensz onder pretext van sijn eijgen particuliere wijn te slijten oock mede van andere wijngaardeniers de wijn tot sijn suppts. prejuditie opcoopen en uijtventen, weshalven den suppt. genootdruckt is, hem tot UE. achtb. te keeren, seer eerbiedigh en reverentelijck versoeckende dat de gemelte Cornelis Stevensz door UE. achtbare ordre magh werden geinjungeert hem te onthouden voortaen de Caapse wijnen tot soodanigen vermindering van prijs uijt te slijten maar wel tot 1/2 Rxr. d’ mengel, gelijck als voorheen gebruijckelijck, niet willende twijffelen off UE. achtbaren sullen gelieve te considereeren dat hij suppt. den tax van gemelte wijn desen jare weder heeft geaccepteert, op belofte van in alles dat hem suppt. soude cunnen prejudiceeren de behulpsame handt geboden tewerden,79 invoegen hem door d’ Hr.Gouverneur zaliger toesegging is gedaan. ‘t Welcq doende &a.’
Waar op den gemelten tapper Cornelis Stevensz naer genomen visie van de requeste, in Rade heeft te kennen gegeven dat hij achtervolgens de schriftelijcke conditien met d’ E.Compa. aangegaan, geauthoriseert was d’ Caapse wijn wel minder, maar niet hooger als een halve Rxr. d’ mengel te mogen uijtslijten, gelijck dan deselve voor jegenwoordig ten prijse van 3/8 Rxr. vercoopende was, met bij voeging dat door de gedachte Marcquart al voor lang mede eerst was gepractiseert en in gebruijck gebracht de brandewijn minder te vercoopen als bij de overicheijt daar op was gestelt, waar nae hij en andere sich mede hadde moeten schicken, invoegen een vreemde saack scheen te wesen van hem te willen constringeeren om ‘t sijne ten gevalle van een ander, op gelijcke hooge prijs te moeten houden, daar hem ter contrarij vrij staet ‘t selve in ‘t geheel oft ten deele wegh te schencken, versoeckende mitsdien bij sijn contract gemainteneert te werden, alsoo tot geen verhoging van prijs buijten sijn eijgen nadeel, soude connen resolveeren. Welcke redenen bij ons in consideratie genomen en overwoogen sijnde, soo is goet gevonden den gedagte Marcquart voor apostille op sijn overgelevert request toe te voegen dat ons niet bevoegt vonden den voorn. Cornelis Stevensz tot het gedaan versoeck van den suppt. te constringeeren, maar dat gaarne sagen sij selven onder malcanderen een middel beraamde dat haar bijde het minste naedeligh moghte wesen, met aanbieding van onse mediatie daar ontrent.

Welcke redenen bij ons in consideratie genomen en overwoogen sijnde, soo is goet gevonden den gedagte Marcquart voor apostille op sijn overgelevert request toe te voegen dat ons niet bevoegt vonden den voorn. Cornelis Stevensz tot het gedaan versoeck van den suppt. te constringeeren, maar dat gaarne sagen sij selven onder malcanderen een middel beraamde dat haar bijde het minste naedeligh moghte wesen, met aanbieding van onse mediatie daar ontrent.
