By the Council of the fortress of Goede Hoope in the criminal case of Jochem Elberts of Amsterdam, sheriff, and Hans Swans of Maesterland, bailiff.170 The man's prisoner having been prosecuted so far that they have voluntarily confessed all their affairs several times without pain of bonds, iron, or threats, of that one openly171, concerning the sinking of the galley the Roode Vos, especially Jochem Elberts, who not only advised but also, together with the injured persons Theunis Aukes and Buysman prinsipal, was aboard in order to take good opportunity thereto & a. and the aforementioned. Hans Swans as co-consent, everything being evident from several well-collected certificates against him and from this Council, as well as especially from the prisoner’s own voluntary confession, not knowing how to bring in more to his own charge or as his own excuse, as if the Council were very modest in asking for clemency and not for justice. Thus, after careful deliberation (as is necessary for such a criminal matter), it has been approved, as the court will be present to request the commanders of the ship moored here to join us here tomorrow to reinforce our Council (so that, having been reinforced), with the others, to help render such a verdict on the aforementioned serious offenses, as will be found to be most certain of the ship's well-being and that its pious and faithful servants belong to it, etc.
Thus done and resolved in the Fort of Good Hope on the date and year as above.
