Whereas Commander Cornelis van Quaelbergh and Council have previously granted the freeman Theunis Dirksz van Schalckwijck permission to earn his living in the forests by hacking and sawing wood, as well as to sell it to the Compe when necessary, or otherwise, with the consent of the government, to deliver it to the freemen at such a price as could be seen per resolution of January 27, 1663, deposited here at the Comptoir, but as the Compe. their accommodation of timber for this place from the forest of Houtbaij, with a raised wood-cutting or sawmill, and according to that, their situation does not permit and allows, because of someone, it is Comps. servants or freemen, privately17 to be cut therein, So it has been understood and resolved in this Council with good consultation, to grant the aforementioned Theunis Dircksz, with his people, that in the abandoned hackeries, the hell and fief and forest,18 for a period of three years, only such timber as might be needed for the freemen, or other timber for carpentry, However under the condition that it may not be sold here to anyone higher than what the ordinance for this purpose has established, dictates and requires, just as it will not be possible to saw any planks there, nor to fell old yellow wood, or other young emerging trees, so that the abandoned forests will grow again, and the Company, with time and at lower costs, as presently possible, can once again serve them.

Thus done and resolved, at the Fort of Good Hope on Cabo d'Boa Esperance, on the day and year aforesaid.

Vermits bij den Commandeur Cornelis van Quaelbergh, en Raet, voor desen, aen den vrijborger Theunis Dirksz van Schalckwijck is toegestaen geweest, om sich in de boschen met ‘t hacken en sagen van hout te erneren, mitsgaders ‘t selve aen de Compe. wanneer het van nooden mochten hebben, te vercoopen, ofte andersints met consent van de overheijt aen de vrijelieden, tot sodanigen prijs te leveren, als per resolutie van den 27en Januarij 1663, hier ten Comptoir berustende can gesien werden, doch alsoo d’ Compe. haer accomoditijt van timmerhout voor dese plaets uyt ‘t bosch van de Houtbaij , met een opgerechte houtcapperij, oft sagerije, moet soeken, en dien volgens, hare gelegentheijt niet toe en laet, omme ijmant, ‘t sij Comps. dienaren ofte vrijelieden, particulier17 daerinne te laten cappen, Soo is in desen Rade met goet overlegh verstaen, en geresolveert, den voorsz Theunis Dircksz te vergunnen, dat met sijn volck in de verlaten hackerijen, d’ hel en leen en bosch ,18 voor den tijt van drie jaren, alleenigh sal mogen cappen, sodanigh timmer-hout als tot gerijff der vrijluijden, ofte andere, om te timmeren van nooden, mochte vallen, Nochtans onder die voorwaerde, dat ‘t selve alhier aen niemant hoger sal mogen vercoopen, als d’ ordonnantie voor desen daer op gestelt, dicteert, en mede brengt, gelyck oock niet en sal, vermogen aldaer eenige plancken te sagen, nochte oude geel houte, off andre jonge opluijckende boomen, te vellen, opdat de verlatene19 boschen wederom aen groeijen, en d’ Compe. metter tijt en minder costen, als tegenwoordigh, haer daer van wederom connen dienen.

Aldus gedaen, en geresolveert, in ‘t Fort de Goede Hoop aen Cabo d’ Boa Esperance, ten dage ende jare voorsz.
