Present: Commander Jan van Riebeecq, Pieter Marville, Michiel Engelken, Jan Munt, Albert Bruijnvisch, Rut Jacobsz Buijs, Roeloff de Man, Willem Bosem,130

Commander and the council of the fort of Good Hope, reinforced by the chiefs of the present Dutch ships stationed here, after various inquiries and further examination it appeared that Cornelis Jansz van Flensburgh, third guard on the admiral's ship 't Wapen van Amsterdam, had stabbed the person of Anthonij Eijckman, boatswain's mate, on the yacht Vlissingen, with a poker in his throat the night before yesterday and fatally wounded him, from which wound he (according to the surgeon's report) died there that night. And it thus seems to appear that the said third guard, according to his confession and various certificates, first of the boatswain's mate, in his service and command, would have been moved, and also requested at his back that, in order to proceed to the end, strong advocates and legal scholars should be assigned to this matter, which are lacking here, as is the time to come to a decision, since the ship Amsterdam is currently also on its departure and at the sail harbour; as well as the other ships are also in haste to follow, whose chiefs have to do their business on board daily, for the advancement of their ship's affairs, and according to that little time remains to come ashore every day for these purposes, etc. Therefore the Council (reinforced as before) in order not to delay the aforementioned ship or ships in their departure, or in the end to cause any hindrance to the aforementioned,131 after careful deliberation in the service of the E. Compe. understood, to refer the matter to the E. Lords Governor General and Councillors of India to Batavia in order to be dealt with further there, as aforesaid E. We will understand this to be the case at their discretion.

And since the aforementioned ship Amsterdam (where the perpetrant is documented) is expected to sail with a good wind, it has also been deemed appropriate to have her detained on the ship Walvis, and, in the meantime, laying out the documents and documents to be charged, to prepare a double to be sent along with the perpetrant, etc., as well as the person of Jan Brouwer, who, due to his insubordination against the aforementioned perpetrant, appears to have been the underlying cause, subsequently to the documents of which were also annexed to the aforementioned.

Thus done and resolved at Fort de Goede Hope on the date as above.

Den Commandr. ende Raet van ‘t fort de Goede Hoope versterckt met d’ opperhoofden van de jegenwoordige hier ter rhede leggende vaderlantsz scheepen, na verscheyde genomen informatien ende nader examinatien gebleecken sijnde, dat Cornelis Jansz van Flensburgh derdewaeck bescheijden op ‘t admiraelsschip ‘t Wapen van Amsterdam , den persoon Anthonij Eijckman bootsmansmaet bescheyden geweest op ‘t jacht Vlissingen , eergisteren avondt met een poock in de strot gesteecken ende doodelijck gequest heeft, aen welcke quetsuijre deselve (volgens ‘t raport van de chirurgijns) ‘s naghts daer aen is comen te overlyden, Ende alsoo schijnt te blijken dat voorsz derdewaeck volgens sijne confessie ende verscheijde attestatien, eerst van den bootsmansmaet, in syn dienst ende commando soude sijn gemoveert, Item oock in sijn rugge gequest sulcx dat om ten uyteynde te procederen, wel cloecke advocaten ende rechtsgeleerden aen dese saecke werck hebben, welcke hier manqueren, als oock den tijt, om tot decisie te comen, dewyle ‘t schip Amsterdam jegenwoordig oock op sijn vertreck ende t’ zeylreet leijt; mitsgaders d’ ander scheepen mede haest staen te volgen, welckers opperhooffden dagelijcx hun dingen aen boort te doen hebben, tot bevorderingh harer scheepssaecken, ende volgens dien qualijck tijt overschiet, om alle dagen tot dese besoignes aen landt te comen &a., Soo is by den Raet (versterckt als voren) om voorsz schip ende scheepen in haer vertreck niet te retarderen, ofte ten eijnde voorsz eenigh belet te causeren,131 na rijpe deliberatie ten dienste van d’ E. Compe. verstaen, de saecke te renvoyeren aen d’ Ed. Heeren Gouverneur Generael ende Raden van India tot Batavia omme aldaer vorders in gehandelt te worden, als opgemelte haer Ed. na derselver goedtvinden sullen verstaen te behoren.

Ende vermits voorsz schip Amsterdam (daer den perpetrant bescheyden is)132 alle uijr met de goede wint staet uyt te loopen, Is oock goedt gevonden den selven op ‘t schip de Walvis gedetineert te laten overgaen, ende tusschen wijlen de stucken ende bescheyden te sijnen laste leggende, dubbelt gereet te maecken om met den perpetrant &a. mede te laten gaan, als oock den persoon Jan Brouwer welcke om sijn inobedientie tegen voorsz perpetrant scheynt de aenleydende oorsaeck geweest te sijn, achtervolgens de stucken, daervan oock bij de voorige g’annexeert synde.

Aldus gedaen ende geresolveert in ‘t Fort de Goede Hope datum als voren.
