In the confession of the sergeant Allert van Hafte and other examinations moreover, showing nothing other than that he stabbed the person Gillis van Muijden in the chest with his sword this morning, that according to the surgeon's report in the presence of the commissioner, he firstly remained dead from the wound but that he would have done so sargantly for the defense and79 of his body and life in accordance with the confession thereto stating & a., against which no contradictory testimonies or evidence appear to be able to cry, The Council (reinforced by the skipper and the sub-merchant of the ship Malacca as well as the skipper of the yacht Erasmus) unanimously understood to report the matter further to My lords, the Governor-General and Councillors of India, to Batavia, to proceed there with the aforementioned matter, as their Honour will understand to belong to them at their discretion, since there are no legal scholars here, so that in such dubious misfortune, neither the Councillor nor the perpetuator could assist in further proceedings and, as they have agreed, to send the same deliberated party to Batavia on the ship Malacca (which is described).

Thus done and resolved at the Fort of Good Hope on the date and year as above.

By de confessie van den sargandt Allert van Hafte ende andre examinatien meer, niet anders blykende als dat hij den persoon Gillis van Muijden desen morgen met sijn degen heeft in de borst gesteecken, dat hij volgens ‘t raport van de chirurgijns ten overstaan van gecommitteerde gevisiteert, van de wonde ten eersten is doot gebleven doch dat hij sargant sulcx soude hebben gedaen totdeffentie ende79 verweringe van sijn lijf ende leven conform de confessie daer van leggende &a., tegen ‘t welcke geen contrarie getuygenissen off blycken synde te crygen, Is by den Raedt (versterckt met den schipper en de ondercoopman van ‘t schip Malacca als oock den schipper van ‘t jacht Erasmus eenstemmig[h] verstaen de saecke wyders te renvojeren aen mijn heren den Gouvernr. Generael ende Raden van India tot Batavia omme aldaer vorders in gehandelt te worden als opgemelte haer Ed. na derselver goedtvinden sullen verstaen te behooren, vermits men hier oock met geen personen van rechtsgeleertheyt versien is, om in soo dubieusen ongeluck den Raet noch den perpetrant tot vorder verhandelinge te adsisteren ende volgens diengoedtgevonden den80 selven gedentineert per ‘t schip Malacca (daerop bescheyden is) na Batavia te laten varen.

Aldus gedaen ende geresolveert in ‘t Fort de Goede Hope ten dage ende jare als boven.
