Pieter Otegno appeared again around noon with the fat captain, father of Schacher and chief of the Caepmans, as well as the following principal chiefs of their army, to make peace, and in order according to their size, on the pre-sale set by instruction of the interpreter Dom, namely:

And together, very earnestly and immediately requesting: to negotiate presently for a permanent peace and closer alliance between them and the Dutch, to resolve all the preceding and past differences, protesting that they would rather have them killed here in the fort than return without a decision of peace, and to that end offering each their neck and head to keep them at bay, etc.

Therefore, the Commander and the Council, assisted by the skipper of the yacht Maria Claes Fransz Bordingh, have agreed to this, but in order to keep them in the best opinion of us and not to arouse any suspicion that we distrust them in anything, also advise judges that the hostages should not be disturbed, as they themselves are coming to meet us and are requesting and praying for peace;

Subsequently, after rehearsing and adding all the nuisances, etc., inflicted on us from time to time,539 negotiations were concluded. The following was agreed upon and decided upon by both parties to be considered firm and inviolable, namely:

That everything the Caepmans did to us and we to them, including the shooting of the Hottento yesterday in the fury, will be considered forgotten and forgiven, as if such a thing had never happened and the aforementioned Hottento had never been in the world, but because of the killing of the young David,540 five years ago, Herry had committed an offense with his, not to treat her as innocent and not to treat Herry with his. willing to do.

That if the Caepmans cause any nuisance or harm to ours and ours to the Caepmans, each will punish, in the opinion of the authorities or the commissioners of the ranks or damaged part, with the advice of the opposing parties, after explanation of the offense.541

That whenever the High Command or freemen have escaped any slaves or people, they shall be informed that, immediately upon receiving this information, all the best will be used to recover them and bring them to the Commander in the fort. Provided that each slave receives as much copper and tobacco as a cow, which they also promise to do for the remaining 10 pieces. That they will no longer ward off any Saldanhars or inhabitants from the country, but rather invite them to us so that they can trade and walk with us in peace. Ultimately, those who fear any nuisance from them will be able to come and sail among us, sheltered, in accordance with the third article mentioned above.

That Caepman will also henceforth arrange for each large ship that arrives here to deliver 10 cattle and 10 sheep for copper and tobacco, 5 each for hunting and fishing, and for the fort every Sunday, 2 cattle for the Commander's staff and two sheep for himself and the fort officials to slaughter. That one of Caepman's men, assisted by the Doman interpreter, will always be allowed to embark on each ship and enjoy two sacks of bread or rice with two or three pieces of spice, and a small barrel of brandy.

All of the above articles are agreed to be observed firmly and conclusively, and are agreed upon by mutual agreement as inviolable: as well as the hostages, also enlarged and by them A seal of agreement, presented to the Commander, 10 beautiful cattle and nine dozen sheep, without wanting to accept anything in return, no matter how much copper, etc., had been presented and forced upon them. However, regarding Herrij, who also appeared with nine or ten of his people to negotiate the peace, and since the one murderer of David was also present and exposed before them all, it was agreed to postpone until further notice and to detain the aforementioned young murderer named Namtesij, who was in the custody of our Claes, Herrij, and Jan Couw.

Thus it was done and decided at the hearing in Fort de Goede Hoope before the aforementioned heads of the Caepmans, on the date mentioned above.

Soo is bij den Commandeur en de Raedt g’adsisteert met den schipper van ‘t jacht Maria Claes Fransz Bordingh, goetgevonden daertoe te treden, doch omme haer in ‘t beste gevoelen van ons te houden ende geen achterdocht te veroorsaecken dat wij haer ergens in mistrouwen, oocq raedsaem g’oordeelt van continuele hostagiers niet te roeren, dewijle sijluijden ons doch selffs tegemoet comen, ende om vreede aensoecken ende bidden;

Achtervolgens ‘t welcke dan na repetitie ende additie van alle overlasten &a., ons van tijt tot tijtaengedaen,539 tot onderhandelingh gecomen sijnde, Is ‘t navolgende g’accordeert ende aen weercanten beslooten voor vast ende onverbreeckelijcq houden namentlijcq:

Dat alle ‘t gene de Caepmans ons ende wy haer aengedaen hebben, Item oocq het dootschieten van den Hottento op eer gister in de furie geschiet voor vergeten ende vergeven sal gehouden worden als of sulcx noyt ware gebeurt en de voorsz Hottento nemmermeer op de werelt was geweest, doch wegen den dootslagh aen denDuytsen540 jongen David over 5 jaren gedaen hadde Herry met de sijne aff te handelen, haer dies als onschuldige niet aentreckende ende met Herrij niet willende te doen hebben.

Dat wanneer de Caepmans d’ onse ende d’ onse de Caepmans eenich overlast off quaet doen, elcq de syne in ‘t aensien van de overicheijt off gecommitteerde der geledeerde off beschadichde partje met advijs van weercanten sal straffen na exigentie van ‘t delict.541

Dat Caepman met sijn leger aen de oostcant van de soute en de verse reviere Liesbeecq sal blijven woonen, omdat aen dees sijde de weijde voor ons alleen te cleijn vallen tensij haer eenige andre inwoonders uijt ‘t landt wilden comen beoorlogen, als wanneer sullen vermogen verbij ‘t fort na achter den Leeuwenbergh comen wijcken onder ons beschut.

Dat Caepman sal versorgen geen van sijn beesten of schapen op Comps. off der vryeluyden corenlanden comen weijden off daer se door d’ onse op gevonden wordende, sullen mogen werden doot geschoten ende laten leggen, tot sulcx bij gecommitteerde van weersijden sal wesen beschout.

Dat altijt wanneer d’ E. Compe. off vrijeluijden eenige slaven of volcq sijn ontlopen, syluijden de weet gedaen sijnde datelijcq alle uijtterste debvoiren sullen aenwenden: om die wederom te crijgen ende bij den Commandeur in ‘t fort te brengen: mits voor elcke slaeff genietende soo veel coper ende tabacq als voor een koebeest, gelijcq sijluijden oocq belooven te doen tot becominge van de noch wegh sijnde 10 stucx.

Dat sijluijden voortaen niet meer sullen stutten eenige Saldanhars offte inwoonders uijt het landt: maer deselve liever tot ons affnodigen omme met ons gerustigh te mogen handelen ende wandelen, ten welcken eijnde sijluijden eenich overlast van deselve vresende sullen vermogen onder ons beschut te comen scheuijlen, conform het derde articul voorsz.

Dat Caepman voortaen oocq sal versorgen voor elcq groot schip dat hier compt te leveren voor coper ende tabacq 10 koebeesten ende 10 schapen, voor jachten ende fluijten van elcx 5 ende voor ‘t fort alle Sondagen 2 koebeesten voor des Commandrs. volcq ende twee schapen voor hem selffs ende d’ officianten van ‘t fort om te slachten.

Dat daer tegen altijt een van Caepmans volcq g’adsisteert met den tolcq Doman sal mogen aen ijder schip aen boort varen ende eens genieten 2 sacken broot off rijs met 2 a 3 stucken specq, ende een cleijn vatjen brandewijn.

Alle welcke bovenstaende articulen sijn bedongen vast ende bondigh te onderhouden, ende met handttastinge aen weercanten voor onverbreeckelijcq beslooten: mitsgaders de hostagiers oocq gelargeert ende door haer tot zegel van onderhoudinge, den Commandeur toegebracht 10 schoone koebeesten ende negen do. schapen sonder daer ijts wes voor te willen genieten hoe seer haer daervoor coper &a., wierd’ gepresenteert ende opgedrongen, seggende niet te willen van den Commandeur scheyden bevoren do. present belooffde voor niet ende tot een zegel van onverbreeckelijcke alliantie te aenvaerden, off souden hun inbeelden geen vaste vreede gemaect te hebben, ende presenterende liever altemalen hier in ‘t fort te blijven ende haer gewillich doot te laten slaen als dat se souden sonder finael slot van vreede wederom moeten gaen.

Is daerop dan ‘t besluijt van vreede met de Caepmans ende beloffte van onderhoudinge der conditie met hanttastinge rondts om aengegaen ende affgehandelt.

Doch aengaende Herrij met negen a thien van syn volcq oocq verschenen: om van vreede te handelen, ende daer oocq voor hun allen present ende ten thoon gestelt sijnde den eenen moorder van David, is verstaen noch tot nader gelegentheijt uijt te stellen ende voorhaelden jongen moorder genaempt Namtesij ende bij d’ onse Claes, bij Herrij ende Jan Couw in detentie te stellen.

Aldus gedaen ende beslooten op de voorsael in ‘t Fort de Goede Hoope ten overstaen van de voorsz hooffden der Caepmans datum voorsz.
