Although the criminal verdict of the delegated judges from the Council of the fort de Goede Hoope was passed yesterday, well and rightly, on the person of Jan Woutersz van Middelborgh; former assistant in the service of the E. Compe., for the reason that (besides his bad compatibilities and gross errors in the disorderly mess-hunting and useless squandering of Comps. victuals) he has been discrediting the Commandr., his imperious chief, with many lying backbitings, and has spoken and divulged many injurious slanders and calumnies behind his back, without even having released from it not only one: but all, Yes, even the most honest women who live here on the Cape, etc., And as he is delinquent with th. sentence, among other things, is also condemned to be pierced with an awl (along with a complaint of everything and a plea to the Justice Department and his affiliated parties for forgiveness, etc.), along with a three-year ban on Robben Island.

However, considering that his wife is currently pregnant with a child, and the multiple intercessions of all the most qualified women, even those in the highest ranks, we have been moved with compassion not towards him as such an unworthy man, but (primarily towards his wife), the municipality. sentence to be mitigated and reduced, so that we, preferring pardon to rigour, have seen fit, in respect of and for the sake of his aforementioned wife, to exhibit332 the scandal of the priem by the tongue, and the banishment on Robben Island; but that he will remain deported from his assistant capacity and appointed as a soldier of 12 guilders a month as he arrived here from India on board the ship De Provintie in 1653, so that he and his wife may still have the cost; provided that he is bound to continue to perform his duties at such times and places as he may be successively instructed by his superiors, holding the Commander and the other officers, as far as this concerns, satisfied with the complaint made and the request for forgiveness, and so forth, provided, however, that no one shall have to rely on this grace or commit sins.

Alhoewel het criminele vonnis van de gedelegeerde rechters uijt den Raet van ‘t fort de Goede Hoope op gisteren gewesen, wel ende ten rechten gevelt is over den persoon Jan Woutersz van Middelborgh; gewesen adsistent in dienst van d’ E. Compe., ter sake hij (behalven sijne quade comportementen ende grove fauten in ‘t onordentlijck mesnagieren ende onnutelijcke verquisten van Comps. Victualien) den Commandr., sijn gebiedend’ opperhoofft, met veele leugenachtige achterclapperijen heefft gaen blameren, ende veele injurieuse lasteringen ende calumnien achter rugge gesproocken ende gedivulgeert, sonder oocq daer van vrij gelaten te hebben niet alleen een: maer al, Ja selffs de eerlijckste vrouwspersoonen die hier aen de Caep woonachtich sijn &a., Ende alsoo hij delinquent bij do. vonnis onder andren oocq gecondemneert is, om (beneffens reclamatie van alles ende biddinge aen de Justitie ende sijne geledeerde partijen om vergiffenisse &a.) met een priem door de tonge geboort te worden, nevens een ban van drie jaren langh op ‘t Robbeneijlant ,

Soo is ‘t nochtans ingesien des selffs huijsvrou jegenwoordigh op ‘t uijtterste van kinde swanger gaet, ende de veelvoudige voorspraken van alle de gequalificeerste vrouwen, selffs oocq die hij op ‘t hooghste geledeert heefft, dat wij met medogentheijtniet over hem als sulcx onwaerdigh, maer331 (voornamentlijck over sijn vrou) sijn bewogengeworden,de gem. sententie wat te mitigeren ende versachten, soodanigh dat wij prefererende gratie voor rigeur, den delinquent ten respecte ende om sijn vrouw voorsz, goet gevonden hebben te exhimeren332 van ‘t schandael der priem door de tongh, ende het bannissement op ‘t Robbeneijlant ; maer dat hij eenlijck van sijn adsistentsqualite sal blijven gedeporteert ende gestelt tot soldaet van 12 gl. ‘s maents soo als hij pr. ‘t schip de Provintie ao. 1653 uijt India hier aengecomen is, op dat hij met sijn vrou noch magh de cost hebben; mits333 daer voor gehouden blijvende sijnen dienst te doen op sulcke tijden ende plaetsen als hem van sijn opperhooffden successive sal gelast worden, als houdende sich den Commandeur ende vorder geledeerde persoonen soo vele deselve aengaet gecontenteert met de gedane reclamatie ende biddinge om vergiffenisse &a. behoudentlijck nochtans dat sich niemant op dese gratie sal hebben te verlaten offte sondigen.
